Agreement

By accessing calibratedcommunication.com or using our services, you agree to these terms. If you do not agree, please do not use our website or services.

Services

Calibrated Communication provides independent technology consulting services, including:

• Fiber and internet carrier comparisons
• Telecom service recommendations
• Carrier serviceability lookups
• Technology strategy consulting

We act as an independent consultant and are not a carrier or internet service provider. Service agreements are between you and the carrier you select.

Our Role

We help you compare and select telecom services. We are compensated by technology services distributors and carriers through commission arrangements. This does not affect the price you pay for services — our compensation comes from the carrier side, not from you.

No Guarantees

While we strive to provide accurate carrier availability and pricing information, we cannot guarantee:

• Specific pricing or savings amounts
• Service availability at your location (carrier data changes frequently)
• Service quality or performance from any carrier
• Contract terms offered by carriers

All carrier comparisons and recommendations are provided as-is for informational purposes.

Your Responsibilities

• Provide accurate information about your business and current services
• Review all carrier agreements before signing
• Make your own decision about which carrier to select

Email Communications

We may contact you by email to share carrier comparisons, service recommendations, or follow-up information related to your inquiry. We also conduct outreach to businesses that may benefit from our services.

• Every email includes a working unsubscribe link
• Unsubscribe requests are honored within 1 business day
• We never sell or share your email address for third-party marketing
• Our emails comply with the CAN-SPAM Act and applicable commercial email regulations

If you receive an email from us and would like to opt out, click the unsubscribe link in the email or contact us directly.

Data Processing & Automated Analysis

To provide our services, we use automated tools and data analysis to:

• Check carrier serviceability at your business address
• Compare pricing and service options across carriers
• Identify businesses that may benefit from a carrier comparison
• Enrich publicly available business information (address, industry, company size) to personalize our recommendations

We use publicly available and commercially licensed business data. We do not access private systems or purchase consumer data. You may request deletion of your information at any time.

Intellectual Property

All content on calibratedcommunication.com and within the platform we build and license, including but not limited to text, graphics, logos, images, user interface design, layout, code, and software, is the exclusive property of Calibrated Communication LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

Registered Copyright

Calibrated Communication LLC holds four approved and registered copyrights with the United States Copyright Office covering the booking and operations platform we build and license, including its AI-Assisted Car & Track Selection and Recommendation System, discovery wizard, underlying database schema, user interface design, and all associated source code:

• Registration Case #1-15120485471 — Website User Interface Design
• Registration Case #1-15123998901 — Booking Engine Source Code & Logic
• Registration Case #1-15127187281 — Events Management System (Inquiry Wizard, Pricing Engine, Race Projection, Live Display, Admin CRM)

These registrations entitle Calibrated Communication LLC to seek statutory damages of up to $150,000 per willful infringement under 17 U.S.C. § 504(c), plus attorney's fees under 17 U.S.C. § 505. Copies of the official registration certificates are available upon request for legal proceedings.

Proprietary Software

The following are proprietary trade secrets and copyrighted works of Calibrated Communication LLC, protected under both copyright law and the Defend Trade Secrets Act (18 U.S.C. § 1836):

• The AI-Assisted Car & Track Selection and Recommendation System, including its recommendation algorithms, matching logic, and user interaction flows
• The discovery wizard interface, question sequences, and personalization engine
• The underlying database architecture, data models, and relational schema
• All custom software, booking systems, membership platforms, and administrative tools
• The overall look, feel, layout, and user experience design of the platform

Prohibited Uses

You may NOT, without our express written permission:

• Copy, reproduce, or duplicate any of our content or code
• Use automated tools, bots, scrapers, or AI systems to extract, copy, or reproduce our content, design, or code
• Create derivative works based on our design, layout, or visual elements
• Use AI or machine learning tools to generate copies, variations, or imitations of our platform
• Reverse engineer, decompile, or attempt to extract our source code
• Use our content, design, or branding to create competing products or services

AI-Generated Copies Prohibited

The use of artificial intelligence, machine learning, or any automated systems to analyze, replicate, or generate copies of our platform's design, content, functionality, or user experience is expressly prohibited. This includes using AI tools to create derivative works that imitate our brand identity, visual design, or business model.

Enforcement

We actively monitor for unauthorized use of our intellectual property. Violations may result in:

• DMCA takedown notices to hosting providers and search engines
• Civil litigation seeking statutory damages up to $150,000 per willful infringement (17 U.S.C. § 504(c))
• Recovery of attorney's fees and costs (17 U.S.C. § 505)
• Preliminary and permanent injunctive relief
• Criminal referral under 17 U.S.C. § 506 for willful copyright infringement

DMCA Designated Agent

In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), the designated agent for receiving notifications of claimed infringement is:

Limitation of Liability

Calibrated Communication is not liable for any damages arising from the use of our services, carrier service disruptions, or decisions made based on our recommendations. Our total liability is limited to the amount you paid us directly (if any).

Governing Law

These terms are governed by the laws of the State of Georgia.
